EU AI Transparency Rules Are Live: An Operational Checklist for SMEs

What Happened
Article 50 of the EU AI Act (Regulation (EU) 2024/1689) entered into force on August 2, 2026, making three transparency obligations immediately applicable to providers and deployers of AI systems:
1. AI Inventory: Organizations must maintain a register of AI systems they develop, deploy, or use—including general-purpose AI (GPAI) like ChatGPT, Copilot, or local models. 2. Timely User Disclosure: When an AI system interacts with natural persons (chatbots, voice agents, AI-generated content), users must be informed before or at the time of interaction that they are dealing with AI. 3. Synthetic Content Marking: AI-generated or manipulated image, audio, video, or text content must be machine-readably marked (watermark, metadata, or visible label) so it can be detected as synthetic.
The rules apply regardless of company size—SMEs are not exempt, though they benefit from proportionate compliance guidance and longer timelines for high-risk system conformity assessments (24–36 months). But Article 50 transparency rules? Effective now.
Why It Matters for Growing Businesses
Most SMEs don't "build AI"—they deploy it. That makes you a deployer under the Act, with direct obligations:
| Your AI Use Case | Article 50 Obligation | |------------------|----------------------| | Chatbot on website | Disclose "I am an AI assistant" before first user message | | Copilot/ChatGPT for staff | Inventory the use case; ensure staff know output is AI-generated | | AI-written marketing emails/blogs | Mark content as AI-generated (metadata or visible notice) | | AI-generated product images | Watermark or embed C2PA metadata | | AI voice agent for inbound calls | Announce "This call uses AI" at start |
The enforcement reality: National market surveillance authorities can audit. Fines for transparency violations reach €15M or 3% of global turnover (whichever is higher). But the real cost is reputational—customers and partners will ask for your AI register.
Practical Actions / Checklist
| Step | Action | Tool/Template | |------|--------|---------------| | 1 | Create AI Inventory Register (Excel/Confluence/Odoo): System name, purpose, vendor, risk class, data processed, deployer owner | VDS AI Register Template | | 2 | Audit all customer-facing touchpoints for undisclosed AI: website chat, email auto-replies, IVR, document generation | Browser dev tools, call flow review | | 3 | Add disclosure notices to every AI interaction point (chat widget, email footer, voice prompt) | Legal-approved copy | | 4 | Enable synthetic content marking for AI-generated assets: C2PA for images, metadata tags for text, audible watermark for audio | Adobe Content Credentials, C2PA tooling | | 5 | Train staff: "If you use AI, log it in the register; if you publish AI output, mark it" | 30-min internal workshop | | 6 | Schedule quarterly register review—new tools appear fast | Calendar invite |
